TEMPORARY PARENTAL INCAPACITY BENEFIT AS A TOOL FOR IMPLEMENTING THE PRINCIPLES OF EQUALITY AND WELCOME STATE

Abstract

This research aims to address the feasibility of granting Aid for Temporary Parental Disability by the General Social Security Regime. The protection of family, health and work are guidelines for Social Security's action, but they are partially helpless with regard to the insured's inability to carry out their work activities to accompany a family member suffering from a serious illness without deprivation of financial resources. from them. Faced with this evident social risk and non-existent protection, this research sought to analyze what are the consequences of the recognition of the right to the benefit in question based on leave due to illness in a family member granted in the specific social security regimes. The general objective is to point out the principle of equality as a normative support for expanding social security coverage, as well as registering the interpretative guideline for the principle of human dignity for the emergence of new rights. To this end, the hypotheticaldeductive approach method, the monographic procedure method and the research technique were used in this work to operationalize such methods, through the use of vast bibliographical research.
