Abstract

Notwithstanding there are severe problems in the prison system that affect prisoners as a whole, an analysis is urgently needed, in the light of intersectionality, about the precariousness of the social rights of the prison population and its consequences on incarcerated women, who, as a result of vulnerability pertaining to the female gender, are more severely affected during the criminal execution. Based on a legal-project study, the main objective of this research is to demonstrate the precariousness of social rights in the prison environment, focusing on women deprived of liberty. Furthermore, adopting Drauzio Varella as a theoretical framework, the specific objectives are to bring notes about the social rights of inmates in contrast to the prison reality, establishing, in sequence, a comparison with intersectionality.
