Abstract

The present essay aims to analyze how the implementation of social rights remains absolutely affected in the face of a minimal State, which has economic development as a priority, however, removing from the respective recipients the rights constitutionally guaranteed, arising from the Social Welfare State. Faced with a State that has the market as a priority, even at the expense of social guarantees, the Constitution is nothing more than an empty text.
