THE REDUCTION OF THE DEATH PENSION IN THE PENSION REFORM: AN ANALYSIS IN THE LIGHT OF SOCIAL JUSTICE

Abstract
The capabilities approach considers the real opportunities that each being has to realize what they value, changing the focus from the equitable distribution of the economy to the life of the human being aiming at the realization of social justice. On the other hand, the 2019 Social Security Reform modified the death pension benefit, changing the amount to be earned and the requirements for perception. The present article establishes as its central objective, in view of the hypothetical deductive method, to analyze the reduction of the death pension resulting from the pension reform in the light of social justice and the approach of Amartya Sen's capabilities. In the end, it is concluded that it is impossible to sustain the Pension Reform merely on economic issues, as it does not consider the real opportunities of each individual, and there is a need for a broader analysis for the realization of social justice
