Abstract
The present study deals with the inversion of the existing hierarchy in the Brazilian legal system, operated by the privileged position that has the Normative Instruction nº 128/2022 in the social security administrative proceedings in the “INSS”. It is believed that such a situation generates insubordination to higher laws in the hierarchy and also generates several obstacles to access to very important social rights.
